Youth Criminal Justice Act on
Plea Resolution in Youth Cases
Miriam Bloomenfeld*
1. Introduction
Superficially, many of the components of the Youth Criminal
Justice Act' share the positive features generally associated with
resolution discussions and agreements, such as speedy resolution
of cases, avoidance of the formal court system and cooperative,
sometimes creative decision-making. The following article
explores the intersection of new YCJA principles and procedural
requirements with the practical exigencies of resolution
discussions and agreements from the following perspectives:
* the YCJA's emphasis on an individualized response to
youthful offending;
* the more rigorous structuring of discretion of key decision-
makers;
  the heightened importance of discretionary decision-
making at the front end of the criminal justice process;
  a new emphasis on the important contribution of the
community and the impact of the offence on the victim;
* the effect of conferences convened pursuant to s. 19
and s. 41 of the YCJA and the endorsement of restorative
processes and approaches;
* Crown Counsel, Ontario Ministry of the Attorney General. Any views or opinions
expressed herein are strictly those of the author and not attributable in any way to
the Ontario Ministry of the Attorney General.
