INTERNATIONAL HUMAN RIGHTS AND UDHR

INTRODUCTION
International law was primarily concerned with Sovereign States in the very beginning and the
rules of international law were not directly deal with the individuals. Because of which there
was no any question arose about human rights, even in national system, naturals, fundamental
or basis rights were recognized very late. The preamble to the universal declaration of human
rights adopted on 101 December 1948 established attention towards 'recognition of inherent
dignity and of equal and absolute rights of all members of the human family is the foundation
of freedom, justice and peace in the world'. There is no any specific definition of 'rights' is
given; it is controversial and subject of jurisprudential debate.
There are a lot of definitions of Human Rights have been defined. Even some of the writer
question the expression human rights because they think it is the most attractive version since
human is marked by the presence of man; so as person. , Some definitions are as below:
According to Bourotus- Ghali, the former secretary General of the UN, human rights constitute
a common language of humanity.
Susan Moller Okin states that a human right is a claim to something (whether a freedom, a
good or a benefit) of crucial importance for human life.
As per Basu, human rights are those minimal rights which every individual must have against
the state or other public authority by virtue of his being a member of human family irrespective
of any other consideration.
A very all-inclusive definition of human rights is to be found in the Protection of Human Rights
Act, 1993 enacted by our parliament under section 2(])(d) , human rights mean the rights
relating to life, liberty, equality and dignity of the individual guaranteed by the constitution and
framed in the international covenants and enforceable by courts in India.
