'A full understanding of the willingness of the Irish courts to
consider citations of foreign courts depends, in part, on an
understanding of the unstated relationship between the Irish
    court and the foreign courts.

INTRODUCTION

HE FOLLOWING work serves to reflect on the purpose, practical application
and effects of judicial cosmopolitanism, a phenomenon at times exemplified
by courts' practice of citing foreign decisions during the course of domestic
litigation. The scope of this work is confined to 'domestic litigation, meaning legal
proceedings that fall outside the realm of private international law. As will become
evident during the course of analysis, judicial cosmopolitanism is solely concerned
with disputes that stem from domestic legislation from within the same jurisdiction.
