Issued Under Delegated Authority December 1, 1978 Application of EXECUTIVE AIR FLEET Docket 33953 CORPORATION for an exemption under section 416(b) of the Act ORDER DISMISSING APPLICATION By application filed November 7, 1978, Executive Air Fleet Corporation requested an exemption from Part 298 of the Board's Economic Regulations to allow it to operate a specially-configured Boeing 727-100 aircraft with a maximum seating capacity of 19 persons. By letter dated November 15, 1978, Executive requested that its pending exemption application be withdrawn and indicated that it will submit in the near future a more comprehensive request to include the operation of a class of executive-configured aircraft. In view of these circumstances, and acting under authority delegated by the Board in 14 CFR 385, we find that the exemption application filed by Executive should be dismissed as moot. ACCORDINGLY, We dismiss, without prejudice to the filing of a subsequent application, the request filed by Executive in Docket 33953. Persons entitled to petition the Board for review of this order in accordance with the Board's Regulations, 14 CFR 385.50, may do so within ten days of the date of service of this order.
