Application of

     MIDSTATE AIRLINES, INC.                 Docket 39736

for unused authority under
section 401(d) (5) (A) of the
Federal Aviation Act of 1958,
as amended


                               ORDER

     On June 22, 1981, Midstate Airlines, Inc. (Midstate) filed an
application under section 401(d)(5)(A) of the Act for unused authority
in the Muskegon, Michigan-Milwaukee, Wisconsin and Muskegon-Detroit,
Michigan markets. In the Muskegon-Milwaukee market the authority of
United Airlines, Inc. is unused within the meaning of section 401(d)(5).
In the Muskegon-Detroit market the authority of Republic Airlines,
Inc. and United is unused within the meaning of section 401(d)(5).
None of the incumbent carriers has filed a notice of intent to
institute service under section 401(d)(5)(G)(i), and Midstate's
application is the only one we have received seeking the authority
requested. No answers have been filed. We will therefore grant
Midstate's application for unused authority in the Muskegon-Milwaukee
and Muskegon-Detroit markets, Docket 39736.

     ACCORDINGLY,

     1.   We grant Midstate's application in Docket 39736 under
section 401(d)(5)(A) for unused authority in the Muskegon-Milwaukee and
Muskegon-Detroit markets; and

     2.   We will issue a formal amendment to Midstate's certificate if
it begins service within 45 days of this order at a minimum of
five round trips per week and continues to provide service of at
least that level for 13 full calendar weeks. Midstate is required
by section 321.4 of our Regulations to file two notices: the first
within seven days after it commences service (see section 321.40 of
