(AERONICA) Docket 46961 for an exemption under section 416(b) of the Federal Aviation Act of 1958, as amended ORDER GRANTING EXEMPTION IN PART Summary By this order we are granting Aerolineas Nicaraguenses, S.A. (Aeronica) an exemption from section 402 of the Act to permit it to resume scheduled foreign air transportation between Nicaragua and the United States. BackQround By Order 82-1-146, adopted January 29, 1982, the Civil Aeronautics Board (CAB) granted Aeronica an exemption from section 402 of the Act to conduct scheduled foreign air transportation of persons, property and mail between Managua, Nicaragua, and Miami, Florida, for a period of one year. By applications filed January 1983, 1984, and 1985, Aeronica requested renewal of its authority to continue its Managua-Miami service. The airline relied on the automatic extension provisions of 5 USC 558(c), as implemented by 14 CFR 377, to keep its operating authority in effect pending final action on its renewal requests. On May 1, 1985, President Reagan issued Executive Order 12513 prohibiting trade and certain other transactions involving Nicaragua, effective May 7, 1985. Based upon the President's findings regarding national security and foreign policy, the Department denied Aeronica's requests to continue to serve the United States, effective May 7, 1985 (Order 85-5-26).
