Docket 43707 under section 419(a)(3)(A) of the Federal Aviation Act, as : amended, to suspend service at : Temple, Texas ORDER EXTENDING SERVICE OBLIGATION on January 8, 1986, Rio Airways, Inc., filed a 90-day notice to terminate its service at Temple, Texas. Rio is the only carrier serving Temple. It was selected by Order 85-8-70 to provide essential air service to Temple consisting of two weekday and two weekend nonstop round trips in the Dallas/Ft. Worth market with 19-seat Beech 1900 aircraft for a two-year period, with a first year subsidy of $173,068 and a second year subsidy of $154,952. The rate term began on October 13, 1985. By Order 86-1-44, the Department prohibited Rio from suspending service at Temple and instituted a replacement case by requesting proposals. i/ No proposals were filed in response to Order 86-1-44. By Order 86-4-5, the Department again sought essential air service proposals for Temple and also requested proposals for Brownwood and Paris, Texas. The latter two points are presently without air service since Eagle Commuter Airlines suspended operations as a result of the Federal Aviation Administration revocation of the carrier's operating certificate. Four carriers submitted proposals, with subsidy requests, in response to Order 86-4-5. One applicant, Air Texas, subsequently withdrew its proposal. We are in the process of holding rate conferences with the applicants. Subsequent to its filing notice, Rio also requested approval to meet the essential air service requirements of Temple while the essential air service replacement case is being processed by providing one-stp service to Dallas/ Ft. Ibrth via Waco, without subsidy, rather than nonstop service as it had been selected to operate. The essential air service determination for Temple requires nonstop service. By Order 86-4-88, the Department granted Rio an exemption to meet Temple's essential air service requirement by providing one-stop service via Waco until replacement service is inaugurated. 1/ Order 86-1-44 directed Rio to maintain essential air service at Temple for a 30-day period after the end of its 90-day notice period, through May 8, 1986. By Order 86-5-23, we extended this service obligation for an additional 30-day period, through June 7, 1986.
