A new section of the New Mexico Drug, Device 8 and Cosmetic Act is enacted to read: 9 PRESCRIPTION DRUG DONATION.-- 10 A. As used in this section: 11 (1) clinic means a facility licensed 12 pursuant to Section 61-11-14 NMSA 1978 in which one or more 13 licensed practitioners diagnose and treat patients and in 14 which drugs are stored, dispensed or administered for the 15 diagnosis and treatment of the facility's patients; provided 16 that clinic does not include the privately owned practice 17 of a licensed practitioner or group of licensed practitioners 18 exempt under Section 61-11-22 NMSA 1978; 19 (2) donor means an individual who donates 20 unused prescription drugs to a clinic or a participating 21 practitioner for the purpose of redistribution to established 22 patients of that clinic or practitioner; 23 (3) participating practitioner means a 24 licensed practitioner who is authorized to prescribe drugs 25 and who registers with the board, and is subject to rules SPAC/Senate Bill 37, aa Approved April 7, 2011 Chap. 119 Laws of 2011
