Chapter 110
I                                AN ACT
2    RELATING TO PUBLICLY OWNED VEHICLES; PROVIDING FOR THE
3    PURCHASE OF VEHICLES THAT MEET CORPORATE AVERAGE FUEL ECONOMY
4    STANDARDS ISSUED BY THE FEDERAL GOVERNMENT.

6    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
7         Section 1. Section 13-IB-3 NMSA 1978 (being Laws 1992,
8    Chapter 58, Section 3, as amended) is amended to read:
9         13-1B-3. ACQUISITION OF VEHICLES--EXEMPTIONS.--
10               A. Seventy-five percent of vehicles acquired in
11    fiscal year 2003 and each fiscal year thereafter by the
12    agencies and departments of state government and educational
13    institutions shall be vehicles that:
14                    (1) meet or exceed the corporate average
15    fuel economy standards for vehicles issued by the national
16    highway transportation safety administration of the United
17    States department of transportation;
18                    (2) are hybrid vehicles;
19                    (3) are capable of operating on alternative
20    fuel with either bi-fuel capability or dedicated engine
21    configurations; or
22                    (4) are plug-in electric vehicles.
23               B. Certified law enforcement pursuit vehicles and
24    emergency vehicles are exempt from the provisions of the
25    Alternative Fuel Acquisition Act. The department may exempt
