CHAPTER 142
1                               AN ACT
2    RELATING TO DOMESTIC AFFAIRS; ADJUSTING INCOME TABLES AND
3    STREAMLINING METHODS USED TO CALCULATE CHILD SUPPORT;
4    AMENDING THE NMSA 1978.

6    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
7         Section 1. Section 40-4-11.1 NMSA 1978 (being Laws
8    1988, Chapter 87, Section 2, as amended) is amended to read:
9         40-4-11.1. CHILD SUPPORT--GUIDELINES.--
10             A. In any action to establish or modify child
11    support, the child support guidelines as set forth in this
IP   section shall be applied to determine the child support due
13   and shall be a rebuttable presumption for the amount of such
14   child support. Every decree or judgment of child support
15   that deviates from the guideline amount shall contain a
16   statement of the reasons for the deviation.
17             B. The purposes of the child support guidelines
18   are to:
19                  (1) establish as state policy an adequate
20    standard of support for children, subject to the ability of
21    parents to pay;
22                  (2) make awards more equitable by ensuring
23   more consistent treatment of persons in similar
24    circumstances; and
25                  (3) improve the efficiency of the court
