RE:   Constitutionality of Section 303(h) of the 2007 Budget Bill
Dear Senator Nicholas and Representative Philp:
You have requested an opinion on the following question:
Is the appropriation to the State Auditor for retiree health
insurance benefits [2007 Supplemental Budget, Original House
Bill No. 001, Enrolled Act No. 85, at Section 303(h)] in
compliance with the Wyoming Constitution. including but not

have their most profound effect on folks living on fixed incomes. These individuals, wxho
are frequently retired, have little or no potential income growth to offset the increasing health
care costs including prescriptions, payments for medically necessary procedures, and health
insurance. Choices therefore have to be made and well care and medical insurance are
frequently sacrificed to pay for more immediate and necessary expenses such as food, heat,
