92-66 CLERKS OF THE COURT:General Sessions: There are no
constitutional or statutory impediments to one
individual holding the offices of State Senator and
Clerk of the Court of General Sessions. There is no
ethical conflict under either the statutes or the
Senate Code of Ethics to an individual voting as a
State Senator on bills involving the classification,
compensation, or duties of the Clerk of the Court of
General Sessions. However, if the duties of the
offices prove so demanding that one or the other is
neglected, then the official could be subject to
ouster or expulsion proceedings. Tenn. Const. Art.
