RE:   Henley v. South Kingstown School District et. al.
Dear Mr. lienley:
The investigation into your Access to Iubic Records Act (APRA) and Open
Meetings Act (OMA) complaint filed against the South Kingstown School District
(School District) and the South Kingstown School Committec (School Commitce) is
comllcte. You allege the following facts.
Following the resignation of Assistant Superintendent Roberta Hill you submitted a
written request dated January 25, 2001 formerly requesting disclosure of the severance
agreenent reached with former Assistant Superintendent Roberta Hill on her departure from
the South Kingston School System. On February 1, 2001, Superintendent of Schools John
M. I larrington responded that [t]o the extent that any severance agreement with Ms. Hill
exists, it is exempt from disclosure under § 38-121-2(4) of the Rhode Island General Laws.
You also contend that [a]t the close of the School Committee's Feb. 13 meeting the
committee [improperly] entered into executive session to discuss the request and response.
You contend that:
any agreement relative to payment and benefits of a public employee,
including a severance agreement, is a public record;
2.    release of the severance agreement would not violate Ms. Hill's privacy
interests:
