SYLLABUS:                                                               2005-001
1.     Pursuant to R.C. 2950.031, a person who has been convicted of, or has
pleaded guilty to, either a sexually oriented offense that is not a
registration-exempt sexually oriented offense or a child-victim oriented
offense may not establish a residence or occupy residential premises in a
nursing home, adult care facility, residential group home, homeless
shelter, hotel, motel, boarding house, or facility operated by an
independent housing agency that is located within 1000 feet of any school
premises.
2.     Regardless of a person's intentions, a person who has been convicted of,
or has pleaded guilty to, either a sexually oriented offense that is not a
registration-exempt sexually oriented offense or a child-victim oriented
offense establishes a residence in a nursing home, adult care facility,
residential group home, homeless shelter, hotel, motel, boarding house, or
facility operated by an independent housing agency whenever he has a
bodily presence as an inhabitant in one of the aforementioned entities.
3.     A person who has been convicted of, or has pleaded guilty to, either a
sexually oriented offense that is not a registration-exempt sexually
oriented offense or a child-victim oriented offense occupies residential
premises in a nursing home, adult care facility, residential group home,
homeless shelter, hotel, motel, boarding house, or facility operated by an
independent housing agency whenever he makes his home, resides, or
lives in a dwelling unit for residential use and occupancy in one of the
aforementioned entities.
