Your letter states: A D iCente alled reason he or she is requesting to go on sick call. In addition, records are maintained of the inmates who actually followed through and went to sick call on each day. These particular records have been maintained since 1980 and the Adult Detention Center is desirous of maintaining these records for only six years. The questions are: May the Adult Detention Center legally destroy these particular records are six years? If not, after what time period could they legally destroy these records? What would be the proper procedure to follow in destroying the records? We assume for purposes of this opinion that Jackson County is exempt from The Local Government Records Act, Miss. Code Ann. Section 25-60-1 et seq. Miss. Code Ann. Section 9-5-171(Supp. 1996) sets forth a records control schedule for county records, and inmate requests for sick call are not included in that list. We are of the opinion that the Adult Detention Center may legally destroy these records after they are no longer of benefit to the agency. For recommendations concerning procedures for destroying the records, we refer you to the Local Government Records Office created pursuant to Miss. Code Ann.
