SHERIFFS:


Sheriff is entitled to $3 O per day for attending
circuit, probate and magistrate courts if his attend-
ance has been requested by the judges of said courts.

Dear Sir:


        We hereby acknowledge receipt of your letter  of
recent date requesting an opinion of this department,  read-
ing as follows:

              We would like to have an opinion
              relative to Sheriff's bill No. 872
              (HB) now in effect.

              Prior to the time the Sheriff went
              on a salary, he drew $3.00 per day
              for each day spent in County, Probate,
              and Circuit Court work. We are a
              fourth class County and he now draws
              the salary provided for this county.

              Will you please advise us if he is
              still entitled to the $3.00 fee for each
              day he attends Circuit and Probate Court
              in addition to his present salary.

        The compensation of sheriffs is regulated by Section
13, Article VI of the Constitution of 1945, which provides:

             All state and county officers, except
             constables and justices of the peace,
             charged with the investigation, arrest,
             prosecution, custody, care, feeding, com-
             mitment, or transportation of persons
             accused of or convicted of a criminal
