Dear Dr. Bitterman:
Re: Applicability of Geographic Limitations to
Time Sharing
Ms. Louanne K. L. Kam's letter dated November 30,
1992 presented the question of whether the more stringent
geographic limitations of time sharing enacted in 1982 are
applicable to a time share registration filing made prior to
the effective date of the amended limitations.
We answer in the affirmative.
We understand the facts to be as follows:
1.   In June 4, 1982, a time share registration filing
was made with the Department of Commerce and
Consumer Affairs.
2.   The project is located in a hotel in an area not
designated for hotel use, resort use, or transient
vacation rental.
3.   Departmental review after June 9, 1982 indicated
numerous deficiencies.
