No. 82-1 STATE CAPITOL HONOLULU, HAWAII 96813 (808) 548-4740 June 29, 1982 The Honorable Jean King Lieutenant Governor State of Hawaii State Capitol Honolulu, Hawaii 96813 RE: Change of name of political party from Independent Party of Hawaii to the Independent Democratic Party of Hawaii Dear Lieutenant Governor King: This is in response to your letter dated June 18, 1982, requesting advice on whether The Independent Party of Hawaii has properly changed its name to The Independent Democratic Party of Hawaii. We answer in the affirmative. A prior Attorney General opinion, dated July 27, 1978, answered a similar question on whether the Independents for Godly Government could change its party name to Aloha Democratic Party. This office advised that it was permissible to make the name change and include the word Democratic as part of the new name. We still uphold the validity of the earlier opinion. The earlier opinion relied on Riddell v. National Democratic Party, 508 F.2d 770 (5th Cir. 1975), which stated that a state has a valid interest in preventing two different parties from appearing on the ballot under the identical name, thereby making it impossible for voters to distinguish between opposing parties. In meeting this goal, the state may grant a registrant the exclusive right to the precise name registered; it may not, however, prevent the use of the title Democratic, when used in some sufficiently different form, by another
