STATE CAPITOL HONOLULU, HAWAII 96813 (808) 548-4740 April 10, 1981 Honorable Jean King Lieutenant Governor State of Hawaii State Capitol Honolulu, Hawaii 96813 Dear Lieutenant Governor King: Re: The Legality of Use of .Title As Name By memorandum dated December 4, 1980, you requested our opinion as to whether you should grant a change of name when it appears that the petitioner's intent is to use the new name as a title, rather than as a name. The facts expressed in your memorandum are as follows: On November 1, 1974, the State of Kentucky granted a request to change the petitioner's name from Gary William Jackson to Gharith Aragorn Elessar Pendragon. The petitioner is now requesting that the Lieutenant Governor additionally change his name to Lord Gharith Aragorn Elessar Pendragon. The question you posed was whether the Lieutenant Governor should grant the change of name when it appears that the petitioner's intent is to use Lord as a title, rather than as a name. We respond in the negative. Article I, Section 9, Clause 8, United States Constitution, provides: No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.
