Dear Mr. Valdez:
This letter will acknowledge receipt of the above referenced
rules.and regulations adopted by the Board of Social Services
at the December 5, 1980 meeting.
These rules replace the emergency rules entitled New Rules
Concerning a Transition Home Base Pilot Program which were
adopted November 7, 1980. These emergency rules were made
permanent pursuant to C.R.S. 1973, 24-4-103(6) at the Decem-
ber 5, 1980 meeting of the Board of Social Services.
Pursuant to the Administrative Procedure Act, particularly
C.R.S. 19739 24-4-103(8)(b)t this office has reviewed the
rules and finds them to be within the authority of the Board
of Social Services to promulgate ands, further, that there
are no apparent constitutional or statutory deficiencies in
their form or substance.
The authority for the Board of Social Services to adopt the
new rules concerning a transition home base pilot program
lies in: C.R.S. 1973, 26-1-108(1)(b), (c); C.R.S. 1973,
26-1-111(1), (2)(b), (e), (f) (Supp. 1979); C.R.S. 1973,
26-1-118 (Supp. 1979); C.R.S. 1973, 26-2-103(11) (Supp.
1979); C.R.S. 1973, 26-2-122 (Supp. 1979); C.R.S.. 1973,
12 CCR 2512-2
