NOLAN Deputy Attorney General THE HONORABLE KEVIN DE LEON, MEMBER OF THE STATE SENATE, has requested an opinion on the following question: Does a police department have discretion to establish guidelines that would allow an impounded vehicle to be released in less than 30 days, under Vehicle Code section 22651(p), in situations where a fixed 30-day statutory impoundment period, under Vehicle Code section 14602.6(a)(1), may also potentially apply? CONCLUSION A police department has discretion to establish guidelines that would allow an impounded vehicle to be released in less than 30 days, under Vehicle Code section 22651(p), in situations where a fixed 30-day statutory impoundment period, under Vehicle Code section 14602.6(a)(1), may also potentially apply. 12-301
