Requested by: BOARD OF ADMINISTRATION, PUBLIC EMPLOYEES' RETIREMENT SYSTEM Opinion by: EVELLE J. YOUNGER, Attorney General William J. Power, Deputy The Board of Administration of the Public Employees' Retirement System has requested an opinion on a question which may be stated as follows: Does Government Code section 20809 or section 20332 preclude the pay- ment of an allowance, or affect credit earned under the Public Employees' Retire- ment Law to former state employees who, after entering federal service, are granted retirement credit in the United States Civil Service Retirement System for their state service? The conclusion is: Neither of the sections preclude the payment of an allowance or affect credit in the Public Employees' Retirement System where the employees become members of the federal system only after leaving state employment. 1
