RE: Retirement of County Employee and Reappointment
on part-time basis
Dear Judge Boyer:
This is in response to your request for an opinion on the
following matter.
Sebastian County's Juvenile Referee is eligible for
retirement on.January 31, 1982. The County wants to
reappoint him on a part-time basis. Your question is
whether there are any problems with this proposal.
We are unaware of any prohibitions on the reappointment of a
retired official. The only factor of which you and the
retired official should be aware is the work test limitation
in the retirement system.
Pursuant to Ark. Stat. Ann. §12-2541.1 (Supp. 1981) and Ark.
Stat. Ann. S12-3305(5.12)(Supp. 1981) the Federal Social
Security Act Retirement Test is incorporated into the
retirement system. Under this test, a retired employee who
receives compensation from any public employer whose employees
are covered by a state supported retirement system will be
subject to certain dollar limitations as Social Security
recipients and may consequently have their annuity reduced.
For the year 1982 those limitations are as follows:
Retired Employee under 65 - $4440 per annum
Retired Employee over 65 - $6000 per annum

Retired Employee 72 and over - no limitation
