Nance, Jr. Nance, Nance, Fleming & Hatfield Attorneys at Law Fidelity National Bank Building West Memphis, Arkansas 72301 Dear Sir: This is in reply to your inquiry in which it is stated: As attorney for the West Memphis School District, I would like to obtain an opinion from the Attorney General's Office concerning the term of office of members of a School Board when the School Board has been increased from five (5) members to a number not to exceed eight (8) members. I am en- closing my opinions to the School District dated April 27, 1971 and May 17, 1971 concerning the procedures to be followed in increasing the member- ship of the School Board and the term of office of the members who are added to the Board. Based upon my research, there is a gap concerning the terms of office when the membership is increased from five (5) to seven (7) members. The letter of May 17, 1971 reflects my research concerning this matter. The School Board desired an opinion from your office concerning the terms of office if the Board is in- creased to six (6) members or to seven (7) members, or to eight (8) members. Basically, increasing the membership of school boards which now have five directors is controlled by Ark. Stat. Ann. S 80-502.1 which provides: Hereafter, the Board of Directors of any school district in this State, which now has or which under the provisions of Act 30 of the General Assembly of 1935 ES 80-5013 is authorized to have five [5] or more school directors, may file a petition with the County Board of Education requesting an increase in the number of school
