Wagnier alerkship in the Depart- ment of Justice. Mr. Wagner was appointed through examination on June 26, 1905, as a clerk in the service of the Panama Canal, and served until June 9, 1906. On September 4, 19o6, he was appointed to a clerkship in the Department of Justice, and served until April 9, 1909, when he resigned from the position of telegrapher and stenographer at $1200 to accept a position on the, Newfoundland Fisheries ArbitrationCommission under the State Departmept. He continued in this positi6n until September, 1910, when he was appointed secretary of the Chamizal Arbitration Com- mission under the State Department, in which position he served until the completion of the work in August, 191 1. His duties in these posi- tions are said to hav'e been principally legal. He did not seek retransfer to the classified-service because he was compelled to undergo an operation which incapacitated him for fifteen months. From February 1 to June 30, 1914, he served as record clerk with the American-British Claims Arbitra- tion Commission. The Attorney General recommends the reinstatement of Mr. Wagner because of the difficulty experienced in obtaining stenographers and type- writers who also have a knowledge of law. In view of the fact that Mr. Wagner was twice appointed through competitive examination, served for nearly four years in the classified service and for over two years in unclassi- fied positions with a good record, the Civil Service Commission concurs in recommending the issuance of an order which involves merely the waiving of the year limit upon eligibility.
