TEXAS STATE SUPERFUND UPDATE
This article compares the Texas Solid Waste Disposal Act and the federal Comprehensive Environmen-
tal Response, Compensation, and Liability Act (CERCLA). While the Texas act is modeled on the federal
act, differences include the type of substances that are actionable, the scope of liability for prior owners
and operators, and the procedure for appeals of agency orders.
