It is this concept that forms the basis for Sect. 3:4 of the General Administrative Law Act (GALA). Having determined what the principle of proportionality entails in other countries, the author shall investigate whether features of such a principle of proportionality can be detected in Dutch legal practice in the administrative law field. ADRIENNE DE MOOR-VAN VuGT 7 CIVIL LAW Comparative Libel Law: Towards a Continental Common Law? Some Comparative Remarks on English, German and Dutch Libel Law. Libel law can be approached as a matter of private law as well as a matter of constitutional or public law. Thus in Germany libel law is traditionally regarded as a collision of constitutional rights, whereas in England it has always been looked upon as a pure civil tort. Even more traditionally Dutch judges have entrenched themselves between both lines: tort with a collision of constitu- tional rights.
