Ronald K.L. Collins introduces some of the difficult First Amendment
issues pertinent to the regulation of any form of communication,
particularly commercial speech. In discussing the conflict between the
liberal viewpoint espousing broad First Amendment protections and the
equally liberal viewpoint hailing the protection of consumers against
potentially misleading corporate expression, Collins outlines the doctrinal
rifts blurring the lines between liberal, conservative, and libertarian stances
on this topic. Further, Collins introduces many of the arguments regarding
both the definition and effects of commercial speech discussed in more
detail by the participants in this symposium. Mr. Collins also highlights the
important contributions that Professor Steven Shiffrin has made to the
debate over commercial speech, the scope of First Amendment protections,
and the value of dissent.
