Commonwealth, 161 A.3d 911 (Pa. 2017) Adam Duh Abstract This case note addresses recent changes in Pennsylvania's interpretation of its Constitutional Environmental Rights Amendment (ERA) by Environmental Defense Foundation v. Commonwealth. Section I of this case note discusses a recent Pennsylvania Supreme Court Decision, Pa. Envtl. Def. Found. v. Commonwealth, which requires certain natural gas revenues be used by the state for conservation purposes. Section II will discuss the stochastic development of the ERA 's interpretation in the Commonwealth. Finally, Section III will discuss the authors opinion of the Court's reasoning for remanded a portion of the case.
