CurrentIy, international legal ramewiorks do not extend the same legal protections to climate migrants as are afforded re ugees anda sium seekers. While international law' recogI:zes the right to aslum based on politica/persecution, there is no internationalright to migrate based on climate-based harms that states are legaly bound to observe. This Comment proposes a climate migration lottery (CML) that / ouldIbeadministeredinternationaly to address currentand uture climate-based migration. Underthis proposal, receiving states ouldagree via a treaty to admit their fair share of the totalp pol oo climate migrants selectedthrough the lottery. Migrants |rom countries /ith a high susceptibility to having large portions o| territory rendered uninhabitable by climate change ''ould be eligible to enterthe CML. This comment argues that a CML can alleviate the strain on regions in developing states that must accommodate internall displaced persons as i ell as the burden on countries that are near lol-ying Paiic island states that will experience significant rates of displacement due to sea level rises.
