On May 10, 1972, pursuant to Section 11 of the Human Rights Act, one Beaty Hayes, a black, of 10945 - 106 Street, Edmonton, Alberta, filed a written complaint with the Administrator of the Human Rights Branch of the Department of Manpower and Labour against Central Hydraulic Manufacturing Co. Ltd., also of Edmonton, alleging that the said limited company refused to employ him by reason of his race and colour through the actions of its principals, Guy Lalonde and William F. Lotoski, contrary to section 5 of the Human Rights Act which section reads as follows: 5. No employer or person acting on behalf of an employer shall (a) refuse to employ or refuse to continue to employ any person, or (b) discriminate against any person with regard to employment or any term or condition of employment, because of the race, religious beliefs, colour, ancestry or place of origin of that person or of any other person.
