In this action for declaratory and injunctive relief with reference to restric- tions imposed on the university community following disorder on the campus of the University of Kentucky in May of 1970, a fed- eral district court dismissed the complaint and the plaintiffs appealed. The federal circuit court of appeals held that, under the circumstances, the actions of the governor of the state and those of the president of the university in imposing restrictions and in calling out the National Guard did not unconstitutionally restrict the right of freedom of speech and assembly or violate 9th Amendment rights.
