                              SMALL CEMETERY CONVEYANCE ACT

JANUARY 14, 2026.-Committed to the Committee of the Whole House on the State
of the Union and ordered to be printed

Mr. WESTERMAN, from the Committee on Natural Resources,
                                       submitted the following

                                          REPORT

                                        [To accompany H.R. 4284]
The Committee on Natural Resources, to whom was referred the
bill (H.R. 4284) to amend the Small Tract Act of 1983 to authorize
the Secretary of Agriculture to convey, without consideration, cer-
tain cemeteries, and for other purposes, having considered the
same, reports favorably thereon without amendment and rec-
ommends that the bill do pass.
                                    PURPOSE OF THE LEGISLATION
The purpose of H.R. 4284 is to amend the Small Tract Act of
1983 to authorize the Secretary of Agriculture to convey, without
consideration, certain cemeteries, and for other purposes.
                              BACKGROUND AND NEED FOR LEGISLATION
H.R. 4284, the Small Cemetery Conveyance Act, amends the
Small Tract Act of 1983 to authorize the Secretary of Agriculture
(Secretary) to convey, without consideration, parcels of federal
land, used or previously used as cemeteries, to state and local gov-
ernments, Indian Tribes, and qualified land grant-merced commu-
nities.' The Small Tract Act currently allows the Secretary to con-
vey parcels, primarily managed by the U.S. Forest Service, that are
smaller than 40 acres and difficult for the agency to efficiently ad-
minister. Many historic cemeteries, particularly out West, are lo-
cated on or near federal lands, creating barriers for communities
and Tribes seeking to maintain, access, expand, and protect these
