handle is hein.cfr/cfr1984005 and id is 1 raw text is: Q L >~General National Archives Services and Administration RecordsService Washington, DC 20408 To Users of this Supplement: The United States District Court for the District of Columbia has issued an order barring implementation of the Office of Personnel Management (OPM) regulations pertaining to reductions in force, performance management, and the applicability of the Fair Labor Standards Act to Federal employees. These regulations were published at 48 FR 49462, October 25, 1983, and codified at 5 CFR Parts 1-1199, January 1, 1984 edition. The Court found that Congress in H.J. Res. 413 had barred these regulations for fiscal year 1984. Judge Barrington Parker has directed the publication of a special Supplement to Title 5 of the Code of Federal Regulations (CFR) which contains the regulatins published in the January 1, 1983 edition of Title 5 which remain in effect by virtue of H.J. Res. 413 and Judge Parker's orders. He also directed that a letter of explanation accompany the Supplement. The OPM regulations published on October 25, 1983 were enjoined by order dated December 30, 1983, National Treasury Employees Union v. Devine, C.A. 83-3322 (D.D.C.), affirmed April 27, 1984 by the United States Court of Appeals for the District of Columbia, National Treasury Employees Union v. Devine, No. 84-5009 (D.C. Cir.). The enjoined regulations were published in the January 1, 1984 revision of Title 5 of the CFR with an editorial note stating that the regulations were currently in litigation. Judge Parker in the case of National Federation of Federal Employees v. Devine, et al. C.A. No. 84-1109 (D.D.C.) May 30, 1984 ordered the publication of this Supplement which contains the regulations which are in effect. Readers are advised that the regulations set forth in this Supplement are in effect and to be utilized only through September 30, 1984 unless extended by the enactment of a relevant statute before that date. Absent such statutory change, the regulations set forth in the January 1, 1984 edition of Title 5 of the CFR will be in effect after September 30, 1984. Readers also are advised to read the Explanation of this Supplement and the codification notes on the use of this Supplement with the January 1, 1984 revision of 5 CFR Parts 1-1199. JO E .
