 LORD WESTBURY'S DECISIONS.



                     RUTHIN CASE.                            1872
                   Reserved Fund of European.               Oct. 22.

THIS was an application by the Guardians of the Ruthin Poor
Law Union for payment out of the Reserved Fund of the European,
constituted and regulated by the European Society's Act, 1859, of
a sum due to the guardians on a bond of fidelity.
  The case turned mainly on the construction and effect of the
proviso to section 7 of the Arbitration Act, which is to the effect,
that nothing therein contained shall affect the Reserved Fund
and the application thereof under the Act of 1859.
  Further legislation respecting the fund being probable, a com-
plete report of the case is not now given.


  Mr. Benjamin, Q.C., (Mr. H. M. Jackson with him) was for the
applicants.

  Mr. Higgins, Q.C., (Mr. Cookson with him) was for the European.

  Mr. Hemming was for the Commissioners of the Treasury.
