James submitted its final report to the council on January 15, 1993. The coun- cil accepted the report, which has been made avail- able to the public. The seven-person committee began its investiga- tion of the James matter following the October 1992 council meeting. The committee members, all of whom are councilors, included Howard E. Manning, Sr., of Raleigh, chair; Patricia I. Pegram of Winston- Salem, vice-chair; Daniel D. Khoury of Manteo; Alex Warlick, Jr., of Jacksonville; L. Patten Mason of Morehead City; W. Erwin Fuller, Jr., of Greensboro; and William O. King of Durham. Because of time and cost constraints, the commit- tee principally reviewed State Bar records relating to James' expense account for the period 1986 to 1992, council minutes setting out policy relating to finan- cial matters, and other State Bar financial docu- ments. An audit of James' expense account prepared by A. James Early, III, CPA, for the period 1990- 1992 was also provided to the committee. Several for- mer State Bar presidents met with the committee on December 4, 1992, to discuss past State Bar practices in connection with staff expense accounts. James and his attorneys provided a detailed written discus- sion regarding James' financial transactions and made an oral presentation to the committee at a meeting on December 16, 1992. In its final report, the committee found that the State Bar is owed a total of $30,108 from James. The committee concluded that reimbursement should be made in those cases in which James failed to ac- count properly for sums received from the Bar or spent Bar funds for personal expenses or purchases. Specifically, the committee concluded that James should repay $5,220 in cash advances which he re- ceived between January 1, 1986, and September 9, 1992, and for which he failed to account appropri- ately.
