By direction of the Board of Commissioners, and with the aid of
a special appropriation from State Bar funds, the Editors of the Bat
Journal are pleased to present to you the within official text of the
Court Rules of 1945, as adopted and published by the Supreme Court
of Michigan. This publication of the Rules and the Index is by spe-
cial permission of the, Supreme Court.
Included in this publication are the Michigan Court Rules, the
Rules of Practice of the Probate Courts of Michigan and the Rules
of the Court of Claims. The comprehensive and detailed Index was
prepared by the Supreme Court Reporter.
This revision of the Rules is the result of numerous conferences
between the Justices of the Supreme Court, the State Bar Committee
on Civil Procedure, a special committee of the Michigan Judges'
Association, the Michigan Committee of the American Bar Associa-
tion on Improving the Administration of Justice, and several members
of the Bench and Bar of Michigan, individually. Space does not per-
mit the listing by name of all those who participated in the work.
While the revision is not drastic, the changes which have been
made are numerous. With a few unavoidable exceptions, however,
the same subject matter treated in any 1933 Rule will be found in
the corresponding Rule of this revision. Hence, a comparative exam-
ination of the various Rules, to determine for yourselves the nature
of any changes made, will not be difficult.
We regret that time did not permit the preparation, for publication
herewith, of annotations indicative of the nature of the various amend-
ments. Annotated versions of the Rules doubtless will be offered
commercially later.
