  RESTITUTION AND UNJUST ENRICHMENT 3D

Generally

D.Or.2023. Cit. generally in case quot. in sup. Purchasers of a machine that extracted cannabinoids from
hemp plants filed claims for unjust enrichment and breach of contract against seller that manufactured
the machine, alleging that seller failed to timely deliver and install a machine that complied with the
specifications required in the purchase agreement. This court denied in part plaintiffs' motion for default
judgment, holding that plaintiffs failed to state a claim for unjust enrichment. The court explained that
plaintiffs failed to show that their claim fell within an established category of unjust enrichment, as
required to state a claim for unjust enrichment under Oregon law and the Restatement Third of
Restitution and Unjust Enrichment. Farmer v. Thar Process, Inc., 705 F.Supp.3d 1218, 1228.

D.Vt.2023. Cit. generally in case quot. in disc. Customer who suffered from Tourette's syndrome sued
clothing store, police officers, and others, alleging that, after store's employees called the police to
report him as a suspicious person, officers falsely imprisoned him by detaining him without probable
cause and without any reasonable suspicion that he had engaged in criminal activity. This court denied
officers' motions for summary judgment, holding that a genuine dispute of material fact existed as to
whether customer's confinement was lawful and whether officers' restraint of customer was total such
that officers were potentially liable for false imprisonment under the Restatement Second of Torts. The
court noted that, where Vermont law was undeveloped, the Vermont Supreme Court frequently looked
to the Restatements of the Law for guidance, including the Restatement Third of Restitution and Unjust
Enrichment. Brush v. Old Navy LLC, 687 F.Supp.3d 452, 493.
