Generally

N.D.Cal.2024. Cit. in case cit. generally in disc. Seller of devices known as reactive magnetron
sputtering reactors sued owner of patents for chambers used in the reactors, seeking a declaratory
judgment that its reactors did not directly or indirectly infringe on any claim of owner's patents. This
court denied in part owner's motion for summary judgment, holding that seller's claims were not barred
by issue preclusion arising from owner's prior patent-infringement action against buyer of seller's
devices, reasoning that the issues in this action were not identical to any of the issues actually litigated in
the prior action, because the theories of infringement in both cases were different. The court noted that
federal courts followed the Restatement Second of Judgment's guidance in defining the issue for
purposes of issue preclusion. Applied Materials, Inc. v. Demaray LLC, 760 F.Supp.3d 965, 975.

D.N.H.2025. Cit. in case cit. generally in disc. Car manufacturer filed claims under the Racketeer
Influenced and Corrupt Organizations Act (RICO) against car dealership, alleging that defendant
participated in a scheme to submit fraudulent sales documents to plaintiff to improperly obtain incentive
payments. This court granted defendant's motion to dismiss, holding that plaintiff s claims were barred
by res judicata arising from a prior action related to plaintiff's termination of its contractual relationship
with defendant, in which plaintiff was denied leave to amend its answer to include its RICO allegations
as counterclaims and did not appeal that denial despite having the opportunity to do so. The court
observed that a res judicata analysis under either federal or Massachusetts law would be the same
because Massachusetts followed the Restatement Second of Judgments in analyzing res judicata issues.
Kia America, Inc. v. DMO Auto Acquisitions, LLC, 775 F.Supp.3d 607, 630-631.
