§ 3. Effect of Violation of International Law

D.P.R.2023. Subsec. (3) cit. in case quot. in sup. A grand jury indicted Venezuelan and Colombian
nationals who were apprehended aboard a go-fast vessel in international waters for allegedly attempting
to import cocaine into the United States in violation of the Maritime Drug Law Enforcement Act. This
court denied defendants' motion to dismiss for lack of jurisdiction, holding that the exercise of
extraterritorial jurisdiction was proper pursuant to the territorial principle under Restatement Second of
Foreign Relations Law of the United States § 3 because defendants were foreign citizens, the
interdiction occurred on the high seas, and Venezuela had consented to the application of United States
law. The court pointed out that one defendant claimed Venezuelan nationality for the vessel, and, while
the Venezuelan government could neither confirm nor deny registry of the vessel, it had waived its
primary right to exercise jurisdiction over the vessel, cargo, and crew to the extent necessary for the
enforcement of United States law. United States v. Hernandez-Gamboa, 686 F.Supp.3d 64, 70.
