You are earnestly requested to raise any further points which occur to you. 1. Should a gratuitous agent be responsible to his principal for non-performance, and if so what is the extent of his liability? (Section 599.) 2. What is the liability of an agent who mistakes the facts upon which his authority is based? (Section 604.) 3. Does an agent have a duty to account for gra- tuities and other benefits received because of his em- ployment but not in fraud of the principal? (Sec- tion 609.) 4. Where an agent deals with his principal, is his duty of disclosure limited to good faith ? (Section 611.) 5. Where an agent has improperly bought from or sold to the principal, may the principal affirm the transaction and hold the agent responsible for the dam- ages caused thereby? Where an agent has made a secret profit at the expense of the principal, what are
