                                CHAPTER 6. CORPORATIONS

                                  TOPIC 3. DOING BUSINESS

§ 167. Foreign Corporation can do Business

Tex.2020. Com. (a) quot. in case quot. in sup. Bus passenger sued public transit authority, alleging that
defendant's bus driver acted negligently by abruptly deploying the brakes to allow a passenger off the
vehicle while plaintiff was standing onboard, resulting in plaintiff falling and injuring himself. The trial
court entered judgment on a jury verdict for plaintiff. The court of appeals affirmed. This court affirmed,
holding that the evidence supported a jury finding that defendant acted negligently when its driver failed
to meet the heightened standard of care applied to common carriers. Citing Restatement of Conflict of
Laws § 167, Comment a, the court explained that defendant was a common carrier that was in the
business of transporting people, because, as a public transit authority, it held itself out as a common
carrier, undertook requests to transport people, and was created to operate a transport business. VIA
Metropolitan Transit v. Meck, 620 S.W.3d 356, 362.
