                         RESPONSIBILITY FOR CHILDREN

TOPIC 1. SCOPE, OBJECTIVES, DEFINITIONS, AND PARTIES

§ 2.03 Definitions

Me.2025. Subsec. (1)(c) cit. in ftn. Former partner of biological mother sought a determination of de
facto parentage under the Maine Parentage Act with respect to mother's minor child, alleging that she
was present at the child's birth, that she moved in and formed a household with mother and the child
very shortly after the birth, and that she was highly involved in the child's life over the course of the
next 32 months that they lived together. The trial court dismissed for lack of standing based solely on
the pleadings and affidavits. This court vacated and remanded for further proceedings, holding that a
hearing was necessary to resolve disputes of fact as to partner's intended and actual role with respect to
the child. The court noted that, if partner had begun living together with mother just before the child's
birth rather than a few weeks after, she might have been entitled to claim parentage under the Act's
nonmarital presumption of parentage provision, which adopted a two-year benchmark as a minimum
period of cohabitation to support a parentage claim from the Principles of the Law of Family Dissolution
§ 2.01(1)(c). Welch v. Chavaree, 340 A.3d 132, 137.
