                          EMPLOYMENT LAW

CHAPTER 1. EXISTENCE OF EMPLOYMENT RELATIONSHIP

§ 1.04. Employees of Two or More Employers

Or.App.2024. Subsec. (b) quot. in sup., cit. in case cit. in sup. Former employee of county library
service district filed a whistleblower-retaliation claim against city, alleging that defendant's termination
of employee was based on the recommendation of the director of the library-service district's
administrative office, whose purportedly improper conduct was the subject of plaintiff's whistleblowing.
The trial court granted defendant's motion for summary judgment. This court reversed and remanded,
holding that defendant was plaintiff s joint employer and that there was a genuine issue of material fact
as to whether defendant knew or should have known of the director's bias when it terminated plaintiff.
The court rejected defendant's assertion that it could not be held liable as plaintiff s joint employer
because the county library service district exercised the right to control plaintiffs day-to-day activities,
explaining that more than one employer could possess a right to control an employee under Restatement
of Employment Law § 1.04(b). McClusky v. City of North Bend, 549 P.3d 557, 567.
